I'm just starting out and don't really have the money to spend on something expensive. I mainly work with friends and family, but thought it would be good to have a contract. Thanks for your help.
You could google it & find one in about 30 sec.
Wedding photography in Austin, Texas has been Mark Gaynor's craft and passion for over 20 years. His dedication has made Gaynor Photography ...
I found a photographer who will do my wedding for free to bulk up her portfolio. Her work is quite wonderful, so I am quite excited, but I feel I need a contract. Our arrangement isn't traditional, so I don't want her to bail at the last minute (I don't know her well enough to know if she would do that or not). Can anyone give me an example of a wedding photography contract? Can they still bail despite a contract?
Here's a sample, you can just modify it to fit your needs:
1. This agreement constitutes an order for wedding portraiture services, including the taking of wedding pictures as agreed to by both parties: The Studio and Contracting Party (Client). Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of the Studio and may be used for advertising, display or any other purpose thought proper by the Studio.
2. If Photographer cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to Photographer's illness or injury, then Studio will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Client(s) agree that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a re shoot and limits Studio's liability to the amount paid under this contract.
3. It is understood and agreed that no other photographer will be allowed to photograph or take pictures at the wedding while the Photographer is working.
4. On signing of this agreement by both parties hereto, the Studio will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all deposits are non-refundable even if the date is changed or if the wedding becomes cancelled for any reason.
5. The service fee is ____ includes ____ hours of photography. A deposit of ____ is due at the signing of this agreement, with a further payment of all necessary expenses (unless otherwise specified) such a films cost, development, batteries, parking, fuel, travel, taxi, hotel charges, etc., to be paid at the date of the event. No photography will take place and no rights are granted until timely payment is made in full. Late payment fees may apply. The fee is non refundable in case of cancellation or date change by client.
I / we, the undersigned Contracting Party, hereby warrant that I am / we are competent to contract in my / our own name(s). I / we confirm that I / we have read the herein agreement prior to its execution and I / we are fully familiar with the contents thereof. This agreement shall be binding upon us and our heirs, legal representatives and assigns. And, we certify that we have received a complete copy of this agreement with all blank lines completed.
Rewritten for you:

Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints, thereof shall remain the property of the Studio and may be used for advertising, display or any other purpose thought proper by the Studio. 2. If Photographer cannot perform this Agreement in whole due to their own negligence or illness (not acts of god) the studio will reimburse clients for the cost of hiring another photographer or find a suitable replacement.

My husband and I just started a wedding photography business not too long ago. We have already shot two wedding and have booked four more for the rest of the year. We were just wondering if we have not registered with the state, if that makes our contract that we make our customers sign not binding? This is all to new to us so please help!! Thanks in advance
Any contract that you sign is binding. Registering you business with the state is not a factor.
Your question does not make it clear if you are looking to make the contract more ironclad or if you are looking for a loophole. However, a contract is a contract. One party is agreeing to pay for the service of the second party.
Laws are different from state to state. Both parties may have to sign the contract in front of a notary to make it legally binding in your state. One hour with a lawyer who deals in business law should be enough time to answer all your questions. I would recommend that you take the time and expense to consult with an attorney. You may need to have a business license in your state and the fines for not having one can be considerable. You might get away with not having one till someone doesn't like the photographs you took at a wedding and sues you. Then all hell can break loose.
Do what you have to do to make your business legal. It works out a lot better in the end.
If you are starting a business, you need to know how to set up your business so that it looks like a business. If you don't, when tax time rolls around, the IRS can declare your business a hobby and require you to pay taxes on your earnings and not allow you to deduct your expenses.
It's worth your while to do things right when starting a small business.
There are lots of books that will tell you everything you need to know.
There is probably a lot of information online as well.
Good luck.

I'm hiring two photography students from the community college to take photos at my wedding and reception in December. Does anybody have links to example contracts or things they wished they could have gone over in advance? The wedding will be in a rural area, so I just want to cover this stuff. We will own the negatives, although we also will sign releases for them to use any of our photos in their portfolios.
-Names: photographer, bride & groom
-wedding date & time
-location(s): ceremony & reception

-number of photo cd's (if any)
-photos ready by date
-total cost
-deposit & date
-final payment & due date

i have been reading a lot of wedding photography questions and a lot of people are warning photographers of not being sued. what are grounds for lawsuits? and just as importantly how do you avoid this? supplies? contracts? any advice will help. thank you!
Wedding photogs are contracted (notice that legally binding word here) to document what some call the biggest day of their lives. Failing to deliver on said contract can result in unhappy customers and lawsuits commence.
There are a host of things that can go wrong with a wedding photoshoot. Equipment failure, the wrong equipment for the job, inexperience of the photog, the photog just having a bad day, the B&G not voicing just what they expect from the shoot, and other things that the photog has no control over like weather.
http://photo.net has some good discussions for starting out.
You will need 2 of everything, especially the most expensive stuff that you own. You will need to have the fastest lens that you can get your hands on like the 24-70 f/2.8. Canon sells one for around $1400, and yes you will need 2 of them. Some ceremonies wont allow flash and the bride will insist on a candle lit ceremony.
Anyways I am starting to ramble. sorry about that
